Who Is Responsible For Arranging a Legionella Risk Assessment

The responsibility for arranging a legionella risk assessment typically lies with the duty holder or responsible person of a premises. This is usually the owner, employer, or landlord who manages or controls the premises, including employers in workplaces and landlords in residential properties. They must ensure that the risk from legionella in water systems is assessed and managed to comply with health and safety regulations.

For workplaces in IRE and the UK, this duty is outlined under the Health and Safety at Work etc. Act 1974 and the Control of Substances Hazardous to Health Regulations (COSHH). Specific guidance is provided in L8 Approved Code of Practice (ACOP) by the Health and Safety Executive (HSE). In rental properties, landlords must comply with their legal duty to assess and mitigate the risk of legionella to protect tenants.

Who Needs a Legionella Risk Assessment?

  • Offices & Commercial Properties: Any business with a water system, from staff restrooms to heating or cooling systems, needs regular assessments to protect employees and visitors.
  • Hotels & Hospitality: Protect guests from health risks and safeguard your reputation with proactive legionella management.
  • Healthcare Providers: Hospitals, care homes, and clinics where vulnerable people are at risk should have ongoing assessments to ensure water systems are safe.
  • Leisure Centres & Gyms: Swimming pools, showers, and spas are high-risk areas for Legionella; we help ensure that they’re maintained to the highest standards of safety.
  • Schools & Universities: Educational facilities must take special care to protect staff and students from Legionnaires’ disease, especially in areas with complex water systems.
  • Residential Landlords & Property Managers: Whether you manage a block of flats or multiple properties, we provide tailored assessments to ensure tenants are protected.
  • Industrial Sites: Factories and manufacturing plants often have complex water systems that need careful monitoring to avoid Legionella outbreaks.
